In regional terms, the largest decline was observed in Ticino (-18.2 percent).<br \/>\nClosures of bankruptcy proceedings showed a similar decrease to openings. In contrast, a more pronounced decline was seen for enforcement proceedings.<\/p>\n<p><strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Eroffnungen-von-Konkursverfahren-nach-Grossregionen-und-Kantonen.xlsx\">Er\u00f6ffnungen von Konkursverfahren nach Grossregionen und Kantonen<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Ouvertures-de-procedures-de-faillite-par-grandes-regions-et-cantons.xlsx\">Ouvertures de proc\u00e9dures de faillite par grandes r\u00e9gions et cantons<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Aperture-di-procedure-di-fallimento-per-grande-regione-e-cantone.xlsx\">Aperture di procedure di fallimento per grande regione e cantone<\/a><\/strong><\/p>\n<p>This is what emerges from the latest results of the statistics on debt enforcement and bankruptcy carried out by the Federal Statistical Office (FSO).<br \/>\nIn 2020, the number of bankruptcy proceedings opened against companies and individuals under the Federal Act on Debt Enforcement and Bankruptcy (FEC) amounted to 12,912, marking a decrease of 928 cases compared to 2019 (13,840 cases).<br \/>\nThe results return a partial view insofar as they do not include proceedings for dissolution of companies due to shortcomings in the organization (art. 731b Code of Obligations), the number of which has also declined in the period under review.<\/p>\n<figure id=\"attachment_92866\" aria-describedby=\"caption-attachment-92866\" style=\"width: 840px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-92866 size-large\" src=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020-1024x683.png\" alt=\"Evoluzione delle aperture di fallimento - Svizzera 2020\" width=\"840\" height=\"560\" srcset=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020-1024x683.png 1024w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020-300x200.png 300w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020-768x512.png 768w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020-1536x1024.png 1536w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Evoluzione-delle-aperture-di-fallimento-Svizzera-2020.png 1920w\" sizes=\"(max-width: 840px) 100vw, 840px\" \/><figcaption id=\"caption-attachment-92866\" class=\"wp-caption-text\">Evolution of bankruptcy openings &#8211; Switzerland 2020<\/figcaption><\/figure>\n<h3>Increase in proceedings in only four out of 26 cantons<\/h3>\n<p>With regard to the number of closures of bankruptcy proceedings, including dissolutions under Article 731b of the Swiss Code of Obligations, the decline observed in 2020 (-946 cases) is almost of the same order of magnitude as the decline in the number of bankruptcy proceedings opened.<br \/>\nCompared to 2019, there was a decline in the number of bankruptcy proceedings opened in all &#8220;major regions&#8221;, ranging from -2.8 percent in Northwestern Switzerland to -15.9 percent in Ticino.<\/p>\n<p><strong> <a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Konkursverfahren-und-Betreibungshandlungen.xlsx\">Konkursverfahren und Betreibungshandlungen<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Procedures-de-faillite-et-actes-de-poursuite.xlsx\">Proc\u00e9dures de faillite et actes de poursuite<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Procedure-di-fallimento-e-procedimenti-esecutivi.xlsx\">Procedure di fallimento e procedimenti esecutivi<\/a><\/strong><\/p>\n<p>Looking at the cantons, Glarus (-26.6%) and Graub\u00fcnden (-24.0%) showed the sharpest declines.<br \/>\nIn absolute terms, the cantons of Ticino, Geneva and Vaud recorded the largest declines (more than 100 cases less than in the previous year). Since in 2020 the gross domestic product (GDP) fell by the largest amount since 1975, one might have expected a wave of bankruptcy proceedings against companies and individuals.<br \/>\nHowever, the results show a decrease in the number of bankruptcies in the year under review.<br \/>\nThere are various factors which can explain this apparent paradox. The main reason lies with the authorities. The Federal Council took the decision very early on to temporarily suspend the obligation for companies to notify the judge in the event of over-indebtedness.<\/p>\n<p><strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Eroffnungen-von-Konkursverfahren-nach-Grossregionen-und-Kantonen-1.xlsx\">Er\u00f6ffnungen von Konkursverfahren nach Grossregionen und Kantonen<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Ouvertures-de-procedures-de-faillite-par-grandes-regions-et-cantons-1.xlsx\">Ouvertures de proc\u00e9dures de faillite par grandes r\u00e9gions et cantons<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Aperture-di-procedure-di-fallimento-per-grande-regione-e-cantone-1.xlsx\">Aperture di procedure di fallimento per grande regione e cantone<\/a><\/strong><\/p>\n<p>It also allowed SMEs to apply for a &#8220;COVID-19 moratorium&#8221;, providing financial aid for hardship cases. This amount, a record since the beginning of the surveys, must be put into perspective, however.<\/p>\n<p><strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Betreibungshandlungen-nach-Kanton.xlsx\">Betreibungshandlungen nach Kanton<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Actes-de-poursuites-par-canton.xlsx\">Actes de poursuites par canton<\/a><\/strong><br \/>\n<strong><a href=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Procedimenti-esecutivi-per-cantone.xlsx\">Procedimenti esecutivi per cantone<\/a><\/strong><\/p>\n<p>And this is explained by an unusual case of bankruptcy proceedings that were opened some 16 years ago and only closed in 2020.<br \/>\nThis particularly long bankruptcy procedure, which ended with a loss of CHF 6.5 billion, is one of the most significant in the history of our country.<br \/>\nWithout this case, the financial losses resulting from bankruptcies closed in 2020, a year marked by the economic crisis induced by the COVID-19 pandemic, would be at a level 30 percent lower than in 2019 (2.3 billion francs).<\/p>\n<figure id=\"attachment_92886\" aria-describedby=\"caption-attachment-92886\" style=\"width: 840px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-92886 size-large\" src=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica-1024x683.jpeg\" alt=\"Problemi finanziari per molte persone causa la crisi economica\" width=\"840\" height=\"560\" srcset=\"https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica-1024x683.jpeg 1024w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica-300x200.jpeg 300w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica-768x512.jpeg 768w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica-1536x1024.jpeg 1536w, https:\/\/swissfederalism.ch\/wp-content\/uploads\/2021\/04\/Problemi-finanziari-per-molte-persone-causa-la-crisi-economica.jpeg 1920w\" sizes=\"(max-width: 840px) 100vw, 840px\" \/><figcaption id=\"caption-attachment-92886\" class=\"wp-caption-text\">Financial problems for many people due to the economic crisis<\/figcaption><\/figure>\n<h3>Significant drop in foreclosures and executions<\/h3>\n<p>The health crisis situation has also had a significant impact on the number of enforcement proceedings initiated or carried out in our country.<br \/>\nIndeed, 2020 saw fewer enforceable precepts (2.6 million, or 13.3 percent less than in 2019), foreclosures (1.5 million;
